We try our best to take care of our members. We have implemented an Anti-Spam Policy, Terms of Use and Privacy Policy that we feel gives us the ability to do what it takes to help ensure that our members have the best possible experience on the StampHaven Community.

As members of StampHaven, you agree to adhere to all guidelines set forth by the StampHaven Staff, as noted here on the TOU and also on the StampHaven Forum, for such StampHaven services including the Gallery and Forum, along with any other service that StampHaven offers that is not listed here. Failure to do so may result in your removal from StampHaven.

Please take a minute to review the Anti-Spam Policy, Terms of Use and Privacy Policy information below. The information below may answer many of the questions that you may have regarding how the StampHaven Community is run. We want our Community to be fun and enjoyable for everyone.

• Please report any post that you may feel is spam.

The StampHaven Anti-Spam Policy

If you have even the slightest feeling that what you will be posting is spam, please don't post it.

What do we consider spam? Any post, private message or other sharing of information (including signatures) through StampHaven which we identify as being made with the sole intent of attempting to promote a company, product or service.

We make the final determination on what we consider to be spam and we reserve the right to delete any post, private message or member signature at any time without notice.

What happens when we find spam? Once spam is reported and/or identified, the spam is deleted.

At our discretion, we may choose to contact the spam poster by private message and/or the email address listed in their account.

We also may choose to ban and delete the account from StampHaven.

The StampHaven Terms of Use

1. General

The StampHaven Staff welcomes you to the StampHaven Community! The StampHaven Community consists of the Message Board (also called a Forum), Private Messaging, and Gallery with commenting. The purpose of the StampHaven Community is to provide a family-friendly, artistic environment on the internet where those who are interested in stamped creations can discuss their craft and associated crafts.

2. User’s Acceptance of Terms of Use

These Terms of Use shall govern your access, visits and participation in the StampHaven Community. By registering for the StampHaven Community account, by using or visiting the Community, you are subject to the Terms of Use. If you do not agree to all of the Terms of Use, you should not access, visit, or participate in the StampHaven Community in any way. StampHaven reserves the right to modify, suspend or terminate the StampHaven Community and/or these Terms of Use from time to time at its sole discretion and without notice. The StampHaven Community is provided on an AS IS and AS AVAILABLE basis. The StampHaven will not be liable to you or any third-party for any claims or actions arising or resulting from your use, visit, or participation in the StampHaven Community and for any modification, suspension, or termination of the StampHaven Community, or termination of your access to the StampHaven Community. The StampHaven owners also reserve the right to reveal your identity (or any other related information collected on this service) in the event of a formal complaint or legal action arising from any situation caused by your use of this forum.

3. Registration

You must be at least eighteen (18) years old to use and participate in the StampHaven Community. If you wish to have a StampHaven Community account, you must provide current, accurate, and complete information about yourself during the account registration process. By joining the StampHaven Community, you expressly agree to be bound by the Terms of Use as entered into by and between StampHaven and you. You are responsible for maintaining the confidentiality of your StampHaven Community password and account, and assume all liabilities and responsibilities for any and all activities that occur under your account. You must maintain and promptly update any account information provided to the StampHaven Community in order to keep such information up to date, accurate and complete. StampHaven reserves the right to refuse access to the StampHaven Community to anyone, at any time, without notice, and for any reason.

You have the ability, as you register, to choose your username. We advise that you keep the name appropriate. With this user account you are about to register, you agree to never give your password out to another person except an administrator, for your protection and for validity reasons. You also agree to NEVER use another person's account for any reason. We also HIGHLY recommend you use a complex and unique password for your account, to prevent account theft.

4. Conduct

You must abide by the following rules of conduct:

a. Do not engage in any unlawful conduct in the StampHaven Community. In particular, do not post, publish, or distribute any defamatory, obscene, infringing or other unlawful material or information in The StampHaven Community.

b. Treat others in the StampHaven Community as you would expect them to treat you. Do not engage in personal attacks or any type of "flaming" of other users. Do not "troll", i.e. post topics or opinions that are designed to provoke a negative response from one or more specific users.

c. Do not use offensive language. If you have any doubts about whether a particular statement might be considered offensive by other users, do not post it.

d. Do not engage in disruptive activity in the StampHaven Community, such as persistent off-topic contributions or comments, or statements that might incite other users to violate these guidelines or participate in illegal activities.

e. Do not contribute content that contains photos, software or other material protected by intellectual property laws, rights of privacy or publicity, or any other applicable law unless you own or have rights to these materials.

f. Do not post any instructions, software or other materials that would allow participants or third parties to harm other users' computers or to inappropriately access software or websites.

g. Do not post any computer programs that contain destructive features, such as viruses, worms or Trojan horses. Do not employ any type of bots for the use of scrolling, showing multiple screens, or other activities that might disrupt online communication.

h. Do not falsely impersonate any other person in the forum, including StampHaven Community Administrators or Moderators.

i. Do not use the StampHaven Community to spam other users, including sending identical and irrelevant submissions to many different discussion areas, Private Messages, your personal signature, the Email User Feature or any other area of the StampHaven Community.

j. Do not misrepresent the source of anything you contribute.

k. While you may use the StampHaven Community to provide information about a business that might be of interest to other users (without spamming them), the StampHaven Community is not to be used as a platform for you to contribute content which may be considered an advertisement for a product, service or business. StampHaven is not responsible for any products, services or businesses which may be found posted in the Community and the purchase or use of any product, service or business that is posted within the StampHaven Community is solely at your own risk, and StampHaven assumes no liability for such purchase or use.

l. Any space provided to you in the StampHaven Community is for your own personal use (not for advertising products or services), and may not be sold, licensed, exchanged or bartered for any purpose. This includes storage space on the StampHaven server, and all areas within the StampHaven Community including Signature Lines. StampHaven reserves the right to edit or delete any information which we may consider to be an advertisement at any time at its sole discretion and without notice. We also reserve the right to modify member permissions to disallow any feature which we consider being used as a means of advertising at any time without notice.

m. You are responsible and liable for all your activities while participating in the StampHaven Community, including anything you contribute.

n. Do not rely on the StampHaven Community for the safe and secure storage of any materials, such as photos, documents and software. The StampHaven Community is not designed as the primary place to store any of these materials, and StampHaven is not responsible for the alteration, deletion or loss of any stored items. Create back-ups for any materials that you contribute to the StampHaven Community.

o. StampHaven reserves the right to remove at any time, without notice, any contribution that violates these guidelines. StampHaven also reserves the right at any time, without notice, to warn, ban and or delete a user who has violated these rules of conduct from any or all areas of the StampHaven Community.

p. Some participants may post Internet website links in the StampHaven Community. StampHaven is not responsible for the content on the websites associated with these links. In addition, we must remind you that some content and links on the Internet contain adult content that is not suitable for children and may be offensive to some users.

q. You are responsible for any actions you may take based on information or advice you receive while online. Use your own good judgment when evaluating information provided through the StampHaven Community or any other communication service. The decision to share information or conduct transactions with anyone is your own; therefore conduct your own research prior to making any decisions.

5. Contributions

There are opportunities for you as a user of the StampHaven Community to actively participate by creating, providing, sharing and uploading information to the StampHaven Community such as comments, photos, artistic projects, ideas or suggestions and other information (collectively “Contributions”). Contributions in the StampHaven Community are subject to the Terms of Use. StampHaven assumes no responsibility or liability over the sharing of Contributions among users.

Any Contributions provided by you to the StampHaven Community may be editable and freely used by the StampHaven Community and other users within the StampHaven Community. Ways in which your Contributions may be used include, but are not limited to, creating comments, articles, documents, FAQs, or knowledge bases. For example, users may incorporate discussion threads written by other users into new documents. Additionally, users may incorporate documents written by others to create a new list of FAQs. StampHaven shall have the right to retain and use Contributions, in edited or unedited form, for any purpose in any way including but not limited to re-posting such Contributions to other areas of the StampHaven Community and website, or by using Contributions in current or future products or services. Therefore, do not upload Contributions to the Communities unless you agree to these Terms of Use. The StampHaven Community is under no obligation to post or use any Contributions provided by users and StampHaven may in fact remove any Contributions at any time at its sole discretion for any reason.

6. Contributions Ownership, Rights and Liability

StampHaven does not claim ownership of any Contributions that you or other users post, upload, submit or otherwise provide to the StampHaven Community. By providing Contributions to the StampHaven Community, you grant to StampHaven a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license to reproduce, prepare derivative works of, publicly display, publicly perform, sublicense, and distribute such Contributions and derivative works. You also grant StampHaven and all users of the StampHaven Community the permission to use your Contributions in other areas of the StampHaven Community.

In order to grant the StampHaven Community and other users of the StampHaven Community the rights, permissions and licenses contained herein, you represent and warrant that you either own or have all the necessary intellectual property rights in the Contributions uploaded or shared to the StampHaven Community and that your Contributions are non-infringing on the patent, copyright or other intellectual property rights of others. Do not post, upload, submit or otherwise provide Contributions to the StampHaven Community that are protected by the intellectual property rights of others, unless you own or have the necessary rights or licenses to use such Contributions.

By uploading Contributions to the StampHaven Community, you warrant that you are not uploading viruses, worms, Trojan horses or other malicious, illegal, or unlawful code which is designed to interrupt, destroy, or limit the functionality of any software or hardware. All Contributions available for download and/or use are provided on an AS IS and AS AVAILABLE basis, without any warranty of any kind and you assume all risks associated with the Contributions that you download. StampHaven expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement of intellectual property rights. In no event will StampHaven be liable for any direct or indirect damages for any claims arising out of your download and/or use of such Contributions.

All Contributions are deemed be provided on a non-confidential basis. StampHaven is under no obligation to and does not control the Contributions created, provided or uploaded to the StampHaven Community. The nature of some Contributions may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. The StampHaven Community reserves the right to take down and remove Contributions that are flagged by users or deemed by StampHaven as objectionable. However StampHaven is under no duty to take down or remove any Contributions.

7. Disclaimer

THE STAMPHAVEN COMMUNITY AND ALL CONTRIBUTIONS AND OTHER ACCOUNT SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. STAMPHAVEN EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. STAMPHAVEN MAKES NO WARRANTY THAT THE STAMPHAVEN COMMUNITY WILL MEET YOUR REQUIREMENTS, THE SITE WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE STAMPHAVEN COMMUNITY OR ANY CONTRIBUTIONS AND OTHER ACCOUNT SERVICES OFFERED THROUGH THE STAMPHAVEN COMMUNITY WILL BE ACCURATE, COMPLETE OR RELIABLE; OR THE QUALITY OF ANY CONTRIBUTIONS AND OTHER ACCOUNT SERVICES PURCHASED OR OBTAINED BY YOU THROUGH THE STAMPHAVEN COMMUNITY WILL MEET YOUR EXPECTATIONS.

ANY CONTRIBUTIONS AND OTHER ACCOUNT SERVICES DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE STAMPHAVEN COMMUNITY IS DONE AT YOUR OWN DISCRETION AND RISK. STAMPHAVEN SHALL HAVE NO RESPONSIBILITY FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF CONTRIBUTIONS AND OTHER ACCOUNT SERVICES.

IN NO EVENT SHALL STAMPHAVEN OR ANY OF ITS PARTNERS OR AFFILIATES BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE STAMPHAVEN COMMUNITY OR CONTRIBUTIONS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT STAMPHAVEN IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

STAMPHAVEN'S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE STAMPHAVEN COMMUNITY OR YOUR USE OF CONTRIBUTIONS, AND OTHER ACCOUNT SERVICES, REGARDLESS OR THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OR WARRANTY OR OTHERWISE), WILL NOT EXCEED ONE DOLLAR ($1).

8. Indemnification

If StampHaven and its subsidiaries, affiliates, directors, officers, agents, and employees should incur any liability to a third party arising out of or in any way related to your use of the StampHaven Community, you agree to indemnify and hold StampHaven free and harmless from any such liability, and from all loss, claims, costs, demands, debts and causes of action in connection therewith, including reasonable attorney’s fees.

The StampHaven Privacy Policy

9. Privacy Policy

StampHaven does not require that you provide personal information; the decision to provide personal information is voluntary. However, in order to register for an account with the StampHaven Community, you must provide your email address. By providing your personal information to StampHaven, you consent to the collection, processing and storage by StampHaven of your personal information in accordance with the following terms of StampHaven’s Privacy Policy.

StampHaven respects the privacy of our visitors (guests and registered members). StampHaven does not collect real names, addresses, phone numbers, financial information or any sensitive personal information. Any information about a registered member collected is used for internal use only such as contacting an individual should the need arise, maintaining a list of registered members, and any other internal use which we deem necessary to maintain the Community. We will not sell or share your registration information with any other party. All information is stored in a database with security measures in place to protect that data. We attempt to make backups of the data several times a week and those backups are saved in a protected location not residing on the internet.

StampHaven does not require you to share personal information such as phone numbers, real names and addresses. Any sharing of such information within any area of the StampHaven Community is done so at your own risk. Although you must be a member to use many areas and features of the StampHaven Community, you should not post any personal information in any area of the StampHaven Community. StampHaven does not guarantee the security of any information posted anywhere in the StampHaven Community. You can view the information that we have on file for you by visiting your profile. You can also edit any information from those areas at any time or contact the administrators of the StampHaven Community to change the information for you.

If at any time you feel that your account has been compromised, you must inform the administrator of the StampHaven Community and immediately change your account password.

StampHaven collects and/or logs Internet Protocol addresses used to access the StampHaven Community web site, the files visited, the time spent in each file, and the time and date of each visit, in the event that you need to be banned from this forum or your ISP contacted. This will only happen in the event of a major violation of this agreement.

Also note that the software places a cookie, a text file containing bits of information (such as your username and password), in your browser's cache. This is ONLY used to keep you logged in/out. The software does not collect or send any other form of information to your computer.
